Terms of Service

1. Acceptance of Terms

By accessing and using the Frosty Fund Sailing Club website (frosty-fund.com) and our services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. About Frosty Fund Sailing Club

Frosty Fund Sailing Club is a Canadian sailing organization providing amateur sailing instruction, club membership, and related maritime services. We are located at 1247 Marine Drive, Vancouver, BC V7P 1T7, Canada.

3. Membership Terms

3.1 Membership Eligibility

Membership is open to individuals who:

  • Are at least 16 years of age (minors require parental consent)
  • Agree to follow all club rules and safety protocols
  • Provide accurate and complete membership information
  • Pay applicable membership fees and dues

3.2 Membership Responsibilities

As a member, you agree to:

  • Conduct yourself in a manner consistent with club values
  • Follow all safety rules and instructor guidance
  • Respect club property and equipment
  • Report any safety concerns or incidents immediately
  • Maintain current emergency contact information
  • Participate in mandatory safety briefings

3.3 Membership Fees and Cancellation

Membership fees are due annually and are non-refundable except in extraordinary circumstances at the club's discretion. Members may cancel their membership with 30 days written notice, but fees paid are not refundable.

4. Sailing Services and Activities

4.1 Course Registration

Course registration requires full payment at time of booking. Course fees are non-refundable within 7 days of the course start date unless the course is cancelled by the club.

4.2 Weather and Cancellations

Sailing activities may be cancelled due to weather conditions, equipment issues, or safety concerns at the sole discretion of club instructors. In such cases, alternative dates will be offered or refunds provided.

4.3 Equipment Use

Club boats and equipment are provided for member use during supervised activities. Members are responsible for any damage caused by negligence or misuse. Personal flotation devices (PFDs) must be worn at all times when on or near the water.

5. Safety and Risk Acknowledgment

5.1 Assumption of Risk

Sailing and water activities involve inherent risks including but not limited to:

  • Risk of drowning or injury from water exposure
  • Equipment failure or malfunction
  • Adverse weather conditions
  • Collision with other vessels or objects
  • Slips, falls, and other physical injuries

5.2 Waiver and Release

By participating in club activities, you acknowledge these risks and agree to hold harmless Frosty Fund Sailing Club, its directors, officers, employees, volunteers, and agents from any claims, damages, or injuries arising from your participation.

5.3 Medical Fitness

Participants must be in good physical health and able to swim. Any medical conditions that could affect safety must be disclosed to club staff. The club reserves the right to exclude participants who pose a safety risk to themselves or others.

6. Code of Conduct

All members and participants must:

  • Treat all individuals with respect and courtesy
  • Refrain from discriminatory or harassing behavior
  • Not consume alcohol or drugs before or during sailing activities
  • Follow all Transport Canada regulations and local marine laws
  • Report any incidents or unsafe conditions immediately
  • Maintain the confidentiality of other members' personal information

7. Website Terms of Use

7.1 Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Frosty Fund Sailing Club and protected by Canadian and international copyright laws.

7.2 Prohibited Uses

You may not use our website to:

  • Transmit any unlawful, harmful, or offensive content
  • Impersonate any person or entity
  • Interfere with or disrupt the website's operation
  • Attempt to gain unauthorized access to any systems
  • Collect personal information about other users

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our services, to understand our practices.

9. Payment Terms

9.1 Fees and Charges

All fees are stated in Canadian dollars and include applicable taxes. Payment is due at time of service unless other arrangements are made in writing.

9.2 Refund Policy

  • Course fees: Full refund if cancelled 7+ days before start date
  • Membership fees: Non-refundable except in extraordinary circumstances
  • Club-cancelled activities: Full refund or rescheduling offered
  • Weather cancellations: Rescheduling or prorated refund

10. Limitation of Liability

To the fullest extent permitted by law, Frosty Fund Sailing Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

11. Indemnification

You agree to defend, indemnify, and hold harmless Frosty Fund Sailing Club and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of our services.

12. Termination

We may terminate or suspend your membership or access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms of Service.

13. Governing Law and Jurisdiction

These Terms shall be interpreted and governed by the laws of British Columbia, Canada. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

17. Emergency Procedures

In case of emergency during sailing activities:

  • Call 911 for immediate emergency response
  • Contact Canadian Coast Guard: VHF Channel 16
  • Notify club staff immediately
  • Follow all emergency protocols as instructed
